The General Terms and Conditions (GTC) of Einbeck Tourism

Dear Guests,

The Public and Business Relations - Tourism Department of the Einbeck City Administration, or Einbeck Tourism for short, offers you various tourism services through the Einbeck Tourist Information Office. Einbeck Tourism serves in various capacities. To ensure smooth contract processing, we have agreed on clear legal regulations with you. Below is an overview of the offers, the position of Einbeck Tourism, and the terms and conditions applicable to each offer. The booking conditions reproduced below form part of the contract to be concluded with you. Please therefore read these conditions carefully!

A. GUEST ACCOMMODATION AND PLACEMENT CONDITIONS

1. Booking

1.1 The basis of the host’s offer and the guest’s booking are the description of the accommodation in the host directory and the additional information in the service description in the booking portal at 
www.einbeck-tourismus.de. Booking can be made via the booking portal on www.einbeck-tourismus.de directly (see 1.2) or upon request, by email, in writing, by telephone, or in person. The booking request upon request will be recorded, processed, and forwarded to the landlord selected by the guest via the Deskline information and reservation system.

1.2 Booking via the booking portal: By clicking the "Book with payment" button, the guest makes a binding offer to the host to conclude a guest accommodation contract. The guest will receive electronic confirmation of receipt of their booking request. The guest accommodation contract only comes into effect upon receipt of the final booking confirmation.

1.3 The guest accommodation contract is concluded as soon as the room(s) or holiday apartment(s) are booked and accepted by the landlord or Einbeck Tourism is/are promised. The contracting parties are the landlord and the guest as tenant. Einbeck Tourism acts solely as an intermediary. The guest will receive a final booking confirmation electronically after completing the booking.

 

2. Billing

2.1 The stated room rates generally apply to overnight accommodation including breakfast. Any deviations will be indicated. For holiday apartments/houses, the rates are per day and unit, or per day and person. They include VAT and service charge. Variable additional costs such as final cleaning for holiday apartments are not included – where indicated.

2.2 The due date for payment is determined according to the terms and conditions stated in the booking confirmation. Unless otherwise agreed, the entire price, including fees for incidental costs and additional services, is due and payable to the host at the end of the stay.

 

3. Arrival and Departure

3.1 Unless otherwise agreed, the booked accommodation will be available from 16 p.m. on the day of arrival at the latest.

3.2 If arriving after 18 p.m., the guest is obligated to notify the host in a timely manner. Failure to do so will result in the host being entitled to reassign the accommodation to another guest two hours after this time for one overnight stay, or after 2 p.m. for multiple overnight stays.

3.3 Unless otherwise agreed, the accommodation must be vacated by 12 noon on the day of departure. If this deadline is not met and unless otherwise expressly agreed between the parties, the host is entitled to demand an appropriate additional fee.

 

4. Cancellation of travel

4.1 The guest and the landlord may cancel a booking at any time. This cancellation must be declared in writing to the booking agency. The date of cancellation is the date on which the cancellation notice is received by Einbeck Tourism (Intermediary office).

4.2 If the guest withdraws from the accommodation contract, the landlord may demand compensation for the travel arrangements made and for the landlord's expenses. If the guest does not use the contractual services, he or she is obligated to pay the agreed price, less any expenses saved by the host. 

This entitles the host, according to applicable law, 

  • for overnight stays without meals (including holiday apartments/houses) max. 90%

  • for overnight stay with breakfast max. 80%

  • for half board max. 70% and 

  • with full board max. 60% 

of the agreed overnight price.

4.3 The host is obliged in good faith to allocate unused rooms to other guests wherever possible in order to avoid losses.

4.4 Until the room is allocated to someone else, the guest must pay the calculated amount for the duration of the contract. 

We recommend taking out travel cancellation insurance.

5. Complaints

Should there be cause for complaint, the guest is advised to contact the respective landlord in any case. The landlord will usually be willing to remedy the situation immediately so that the guest receives the services promised in the host directory/on the booking portal. The guest is obligated to immediately report any defects and malfunctions to the host and demand remediation. If the guest negligently fails to report any defects, the guest's claims against the host may be completely or partially void. A notification of defects, which can only be made to the agent, Einbeck Tourism is not sufficient.

 

6. Liability

The legal regulations apply. Einbeck Tourism Within the framework of the information and reservation system, is only liable for the proper mediation and forwarding of the booking to the landlord. Einbeck Tourism is not liable for the actions and omissions of the landlord.

B. BOOKING CONDITIONS FOR CITY & EXPERIENCE TOURS AND PROGRAMS FOR GROUPS

1. Booking / Conclusion of contract

Bookings can be made electronically, in writing, or by telephone. The contract is concluded as a work contract pursuant to Section 631 et seq. of the German Civil Code (BGB) upon our booking confirmation.

 

2. pay

3. Services and prices

Unless otherwise agreed in writing, the service and price information in the booking confirmation shall apply exclusively. The provisions in C.2.2 and C.4 of these booking conditions apply accordingly.

3.1 The maximum number of participants (group size) for city and adventure tours is 25 people. Exceptions are marked accordingly. If the group size exceeds the limit, an additional tour guide is required. Special arrangements are only possible in exceptional cases after written agreement with the Einbeck Tourist Information Center. The maximum number of participants for group programs varies. The current tourist brochure and the information on www.einbeck-tourismus.de are decisive.

3.2 Delays must be reported to the tour guide via their mobile phone number as soon as possible. The tour guide will wait 30 minutes for 90-minute tours and 15 minutes for 60-minute tours at the agreed meeting point for the entire group (guest) to arrive. If the duration of the booked service must be reduced due to the group's delay, the price agreed upon in the confirmation must still be paid. A right to full service in the event of late arrival exists only to the extent permitted by natural conditions or the opening hours of public buildings, museums, etc.

For programs that include a catering service, if there is a delay of more than 30 minutes, it cannot be guaranteed that the service can still be provided or can be provided in full.

3.3 For bus tours where the group travels by private bus, the guest is responsible for ensuring that a seat with a seatbelt and a functioning microphone system are available for the tour guide. If seatbelts are not available, the tour guide is entitled to refuse the guided bus tour. If the microphone system is missing or damaged, it may not be possible to provide commentary during the tour. Regardless of this, the agreed fee remains payable.

3.4 The type and scope of the contractual services are determined by the service description in the booking confirmation. Any changes, additions, or ancillary agreements must be made in writing. 3.5 For city and adventure tours, as well as group programs billed per person, the guest must notify the exact number of participants no later than 48 hours before the event. In the event of any deviations from the previously confirmed number of participants, the guest will receive an updated booking confirmation. 4. Withdrawal, cancellation, rebooking

4.1 If a service that has already been booked is cancelled, Einbeck Tourism a processing fee of €15 per tour/group program ordered.

4.2 If you cancel less than 24 hours before the agreed appointment, a cancellation fee equal to the minimum fee for the respective tour will be charged.

4.3 If the traveler cancels a guided tour/group program after it has begun for reasons for which he is responsible, Einbeck Tourism Right to the full price.

4.4 If rebookings can be made, a rebooking fee of €5 per tour/program will be charged.

 

5. Other provisions

For contracts for city and adventure tours as well as programs for groups, provisions C. 7 to 8 of these booking conditions apply accordingly.

C. TRAVEL CONDITIONS FOR ACCOMMODATION ARRANGEMENTS

The regulations in this section apply to overnight accommodation arrangements in the brochure “Offers for Groups” and on www.einbeck-tourismus.de.

 

1. Conclusion of the contract

1.1 By booking (travel registration), which can be made verbally or in writing, the guest offers Einbeck Tourism the conclusion of a travel contract on the basis of the advertisement, all additional information in the booking basis and these travel conditions.

1.2 The travel contract is only concluded with the written booking confirmation from Einbeck Tourism to the traveler.

 

2. Performance obligation of Einbeck Tourism

2.1 The performance obligation of Einbeck Tourism arises exclusively from the content of the booking confirmation in conjunction with the brochure or travel advertisement valid at the time of the trip on www.einbeck-tourismus.de subject to all information and explanations contained therein.

2.2 The transport services refer exclusively to the transfer to or from Einbeck specified in the service description. The traveler is responsible for transport from their place of residence to Einbeck. This also applies to the traveler's luggage. Liability of Einbeck Tourism Service providers, in particular accommodation providers and travel agencies, are exempt from Einbeck Tourism not authorized to give assurances or to enter into agreements that go beyond or contradict the travel advertisement or the booking confirmation or that change the confirmed content of the travel contract.

 

3. Down payment and final payment

3.1 A 20% deposit of the travel price is due immediately upon conclusion of the contract (receipt of the booking confirmation). The due date for the remaining payment depends on the arrangements agreed upon with the guest or client and noted in the booking confirmation.

3.2 Cancellation, processing and rebooking fees are due immediately.

 

4. Withdrawal and termination by Einbeck Tourism

4.1 Einbeck Tourism may terminate the contract after the start of the trip if the traveler persistently disrupts the implementation of the contract despite a warning or if he/she behaves in such a way that the immediate cancellation of the contract is justified. The local representatives of Einbeck Tourism (especially the service providers, tour guides and tour leaders) are authorized in these cases to protect the rights of Einbeck Tourism to perceive. 4.2 Einbeck Tourism may withdraw from the travel contract if the minimum number of participants specified in the specific travel advertisement is not reached in accordance with the following provisions: 

a) Einbeck Tourism is obliged to inform the traveller immediately of the cancellation of the trip if it is clear that the trip will not take place because the minimum number of participants has not been reached.

b) A withdrawal from Einbeck Tourism later than 20 days before the start of the trip is not permitted.

4.3 Provided Einbeck Tourism is obliged to refund the price of the trip as a result of a cancellation, the refund must be made immediately and in any event within 14 days of receipt of the cancellation notice.

 

5. Cancellation by the customer, rebooking

5.1 In the case of package deals, day trips and multi-day trips, the traveller can cancel the booking at any time up until the start of the trip by making a declaration to Einbeck Tourism which must be in writing, withdraw from the travel contract.

5.2 In case of cancellation by the traveler, Einbeck Tourism the following lump sum compensation:

 a) A processing fee of €15 will be charged upon booking

 b) from 21 to 7 days before the start of the trip 40% of the travel price

 c) from the 6th day before the start of the trip, or in case of non-arrival, 60% of the travel price

 d) Bus tour operators can cancel free of charge up to 4 weeks before the trip

5.3 The passenger is permitted to Einbeck Tourism to prove that they actually incurred no costs or lower costs than the claimed flat rate. In this case, the traveler is only obligated to pay the actual costs incurred. 

5.4 Einbeck Tourism reserves the right, in individual cases, to charge a higher compensation for costs incurred, which must be specifically quantified and documented to the traveler. 

5.5 Einbeck Tourism However, the traveller cannot claim compensation if unavoidable, extraordinary circumstances occur at the destination or in its immediate vicinity which significantly affect the performance of the package tour or the transport of persons to the destination.

6. Obligations and termination of the traveler

6.1 The traveller is obliged to report any defects immediately Einbeck Tourism. or his representative (tour guide, tour leader) and demand redress. The deadline shall not apply if Einbeck Tourism the remedy is refused or if immediate remedy is necessary.

 

7. Liability

8. Place of jurisdiction, miscellaneous

8.1 Should any of the above provisions be or become invalid, the remaining provisions shall remain valid and the validity of the travel contract shall remain unaffected.

8.2 Place of jurisdiction for claims by the traveler against Einbeck Tourism is Einbeck.

D. PUBLIC TOURS AND EXPERIENCES

1. Object of mediation

1.1 Einbeck Tourism offers its own and third-party tourism services through an electronic reservation system. Individual tickets can be purchased there for the available dates.

1.2 Einbeck Tourism is the organizer of the self-services. These are marked accordingly in the shopping cart.

1.3 Third-party services are marked separately in the shopping cart. The terms and conditions of the respective service providers apply. Einbeck Tourism acts solely as an intermediary. 

2. Ticket purchase
Booking through the booking & more experience shop obligates you to purchase tickets, which are then valid exclusively for the booked service and the respective date. Returns or refunds are only possible under the terms and conditions specified for the service.

3. Non-appearance
If you fail to show up for the booked service, your ticket will be forfeited without replacement. No refund is possible.

4. Payment
Payment of the amount shown at the time of booking is made directly to the service provider listed for the service. Upon receipt of your payment, you will receive an electronic booking confirmation, which you can use to access the booked service. 


5. Withdrawal / Cancellation

5.1 You may cancel your booking at any time by submitting a written declaration (at least by email) to Einbeck Tourismus or the service provider listed on your booking confirmation. Your cancellation must include your booking number. 

5.2 In the event of cancellation of a service offered by Einbeck Tourism, the full amount stated on the booking confirmation must be paid. Free cancellation of booked tickets is not possible. 

5.3 For cancellation conditions for services where Einbeck Tourismus acts only as an agent, please refer to the terms and conditions of the respective service providers. 

6. Minimum number of participants

6.1 A city tour can only be conducted if a minimum number of participants is reached. If this number is not reached, the tour can be canceled (up to one day in advance), and the ticket price will be refunded. Further claims, such as reimbursement of travel/travel expenses, are excluded.

6.2 If the tour is cancelled, the ticket price can only be refunded to the original purchaser.

7. Vouchers

7.1 If the customer is in possession of a voucher for a city tour or tour, it is valid for 3 years from the date of issue. 

7.2 The voucher can only be redeemed for the corresponding tour. 

8. Liability / Einbeck Tourism as an agent for third-party services

8.1 The liability of Einbeck Tourismus as the organizer for its own services is limited to the fulfillment of the agreed scope of services and the agreed timeframe and is limited to the sales price of the ticket. 

8.2 For third-party services, Einbeck Tourism acts as an agent and is not responsible for the proper execution of the arranged third-party services, but only for the proper arrangement of the aforementioned third-party services. Einbeck Tourism is not liable for non-performance or poor performance of the arranged contract. Furthermore, Einbeck Tourism is not liable for simple or gross negligence or for any personal injury or property damage.

8.3 Claims for non-contractual provision of services must be addressed immediately and exclusively to the respective service provider. 

E. ONLINE SHOP FOR SOUVENIRS

1. General / Scope

1.1 These general terms and conditions apply to the sale of items from our souvenir shop. By making a purchase, you acknowledge their acceptance. 

1.2 These general terms and conditions govern all deliveries and services provided by the Einbeck Tourism souvenir shop. Deviating and/or supplementary agreements require the express written consent of Einbeck Tourism. Consent via email is sufficient.


2. offer

The presentation of products and souvenirs in the online shop is a non-binding product presentation. It does not constitute a legally binding offer. The contract is concluded upon completion of the order process on the online shop website and confirmation of the order by Einbeck Tourism via email.


3. Prices, payment terms & delivery

3.1 The prices displayed on the webshop's website at the time of ordering apply. All prices quoted are final prices in euros, including VAT. 
Once the booking process has been completed, discounts can no longer be taken into account.

3.2 Packaging and shipping costs are charged separately and are shown in the shopping cart during the ordering process.

3.3 Einbeck Tourism accepts all payment methods offered on the website during the ordering process. Customers choose their preferred payment method. 

3.4 The goods are delivered to the customer by a third-party provider (delivery service). 

4. Withdrawal 

4.1 Einbeck Tourism is entitled to cancel a customer's order (unilateral right of withdrawal) if the customer violates specific conditions established by Einbeck Tourism (such as delay in payment).

4.2 Einbeck Tourism is also entitled to cancel an order if the desired goods are currently not available. 


5. Passing of Risk
Delivery of the goods is at the customer's risk. Risk is transferred to the customer upon handover of the goods to the transport company. This also applies if Einbeck Tourism has covered the transport costs. Complaints regarding transport damage (e.g., damaged packaging upon receipt of the goods) must be made directly to the transport company by the customer within the specified deadlines.


6. Warranty
Einbeck Tourism guarantees that the goods sold are free from material and manufacturing defects at the time of transfer of risk and that they meet the contractually guaranteed characteristics. Einbeck Tourism is liable for the absence of a guaranteed characteristic, in cases of intent or gross negligence. Claims under the Product Liability Act are not affected. Should defects occur for which Einbeck Tourism is responsible, and should the replacement delivery be defective in the event of an exchange of the goods, the buyer is entitled to a replacement or a reduction in price. 

 

7. Return and refund

7.1 Upon receipt of the goods, the buyer must immediately inspect the delivered goods and report any defects in order not to lose his/her warranty claims. 

7.2 Delivered goods will only be accepted for return following a prior written agreement between the buyer and Einbeck Tourism. Simply returning the goods is not sufficient. The withdrawal period is 14 days.   

7.3 The buyer is responsible for the return shipping costs. Einbeck Tourism will not accept returns without postage paid. There is no right to a resend of the goods.
